Family Storage Terms of Use

These Terms of Use (hereinafter the “Terms”) set forth the conditions for using “Family Storage” and all related services (hereinafter the “Service”) provided by Tradition Blue Co., Ltd. (hereinafter the “Company”).

Article 1 (Definitions)

The terms used in these Terms are defined as follows.

1. The Site: “Family Storage” operated by the Company (http://familystorage.jp), and any related sites, apps, etc. with different domains that the Company may provide in the future.
2. The Service: The storage and sharing of information, generation of family trees, recording of life logs, and all other services provided on the Site (including new services added in the future).
3. User: Any individual or corporation that uses the Service after agreeing to these Terms in accordance with Article 3.
4. Registration Information: The email address, password, name, and other information submitted to the Company by a User in order to use the Service.

Article 2 (Scope of Application and Amendment of the Terms)

1. These Terms apply to all relationships between the Company and Users concerning the use of the Service.
2. The Company may amend these Terms at its discretion in any of the following cases:
   • Where the amendment of these Terms conforms to the general interests of Users.
   • Where the amendment of these Terms does not contravene the purpose of the contract and is reasonable in light of the necessity of the amendment, the appropriateness of the amended content, and other circumstances relating to the amendment.
3. When amending these Terms, the Company shall set the effective date of the amended Terms and give notice by posting on the Site or by other means. A User who uses the Service after the amended Terms take effect shall be deemed to have agreed to the amendment.

Article 3 (Registration and Approval)

1. Any person wishing to use the Service shall apply for registration in accordance with the procedures specified by the Company, after agreeing to these Terms.
2. If the Company determines that any of the following grounds exist, it may refuse to approve a registration, or revoke the right of use even after approval. The Company shall have no obligation whatsoever to disclose its reasons.
   • Where false information has been submitted.
   • Where the application is from a person who has previously violated these Terms.
   • Where the Company determines that the applicant is an antisocial force (an organized crime group, a member of an organized crime group, a right-wing group, an antisocial force, or any other person equivalent thereto), or cooperates in the maintenance or operation of such a force through the provision of funds or otherwise.
   • Any other case in which the Company deems the registration inappropriate.

Article 4 (Ownership of Intellectual Property Rights)

1. Intellectual property rights in the text, images, programs, family tree layouts and designs, know-how, and other elements constituting the Service belong to the Company or to third parties holding legitimate rights.
2. Copyright in information uploaded to the Service by a User (text, family photos, etc.) is retained by the User. However, the User grants the Company a free and perpetual right to use (reproduce, adapt, publicly transmit, etc.) such information to the extent necessary for providing and maintaining the Service, improving its systems, and advertising and promoting the Service.
3. Users may not, without the Company's prior written consent, reproduce or republish information obtained through the Service beyond the scope of private use, or use it for the research work of third parties or similar purposes.

Article 5 (Prohibited Acts)

In using the Service, Users shall not engage in any of the following acts:

1. Acts that violate laws and regulations or public order and morals.
2. Acts that infringe the intellectual property rights, privacy, reputation, or other rights of the Company, other Users, or third parties.
3. Acts of improperly obtaining information on the Site by scraping or other technical means.
4. Acts of using the Service for background investigations of third parties, discriminatory acts, or similar purposes.
5. Acts of impersonating other Users or third parties using false information.
6. Acts that place an excessive load on the servers or networks of the Service.
7. Any other acts that the Company deems inappropriate.

Article 6 (Disclaimer)

1. The Company makes no warranty whatsoever as to the accuracy or truthfulness of the information provided through the Service, or as to whether any particular family line can be traced.
2. The Company shall bear no liability whatsoever for any damage to Users arising from delays, interruptions, or suspension of the Service due to system maintenance, force majeure such as fire or power outages, unauthorized access by third parties, or the like.
3. The Company shall not be involved in any dispute arising between Users or between a User and a third party, and the User shall resolve such dispute at their own responsibility.
4. Where damage is caused to a User due to the Company's negligence (excluding gross negligence), the Company's liability for damages shall be limited to the greater of the usage fees received from that User in the month in which the damage occurred, or ¥1,000.

Article 7 (Handling of Personal Information)

The Company shall handle Users' personal information appropriately in accordance with the “Privacy Policy” separately established by the Company.

Article 8 (Governing Law and Jurisdiction)

1. These Terms shall be governed by and construed in accordance with the laws of Japan.
2. In the event of any dispute concerning the Service, the Tokyo District Court shall have exclusive agreed jurisdiction as the court of first instance.
